Terms and Conditions (Are you under the age of 18? You are not permitted to use the services offered within the Digital Assets of Haggz. In any event, this document may be somewhat complex and it is advisable to consult an adult)

By using the application and/or the website and/or any other digital asset belonging to Haggz, as defined below, you agree to be bound by and to act in accordance with the terms detailed in the Terms of Use and the Privacy Policy, and you hereby declare that you have read these terms and agree to them. If you do not fully agree to all the terms detailed in the Terms of Use, please immediately cease any further use of the Digital Assets.

1. Introduction

וובוסיאס טכנולוגיות בע"מ, a private limited company, company no. (ח.פ.) 517273348, is the owner and operator of the Haggz (حجز) application for iOS and Android devices, as well as of other digital assets which include the website haggz.com, the public listing pages and share links, and sub-sites and affiliated sites, including the listing management tools used by advertisers and Business Customers (such as "My listings", listing statistics, the list of job applicants and appointment management) (referred to collectively and individually as the "Digital Assets"). The owner and operator is referred to in these Terms as "Haggz" or the "Operator". There are various services and/or various sections in the Digital Assets that are operated and/or may be operated by third parties on behalf of Haggz. The Terms of Use detailed below are intended to regulate the browsing and use of the Digital Assets. In the event of any question and/or problem, the Operator may be contacted through the "Contact us" screen in the application or by email: haggz.company@gmail.com

Browsing and use of the Digital Assets are subject to your prior consent to the terms of use as shall be detailed below in these Terms (the "Terms of Use") and in the privacy policy (the "Privacy Policy"). In these Terms, the use of the word "use" and its various derivatives includes the following actions: downloading the application and/or visiting the Digital Assets and/or browsing the Digital Assets and/or registering in the Digital Assets and/or using one of the services/products of the Digital Assets and/or any other use of the Digital Assets. Haggz maintains the privacy of the users of the Digital Assets in accordance with the rules of the Privacy Policy published in the application (Profile → "Advanced Settings") and via the link: https://haggz.com/privacy-policy , as updated and amended from time to time by Haggz. The said Privacy Policy constitutes an integral part of these Terms of Use, and your consent to these Terms of Use shall be deemed your consent to the Privacy Policy.

From time to time, and for purposes of design and convenience, the form of address in the Digital Assets and/or in the Terms of Use may be in the feminine or the masculine, but it always refers to both genders and to the plural as well.

Although Haggz makes its best efforts to adapt the Digital Assets to each user in the best possible manner, the Digital Assets are, by their nature, assets intended for the public as a whole, and therefore the information contained in them is not intended for any particular user.

The use of the Digital Assets, with all their various services, is at your sole responsibility. Therefore, we ask that you read the Terms of Use and the Privacy Policy carefully before you use the Digital Assets.

Haggz is entitled to update the Digital Assets at any time, including by releasing new versions of the application through the App Store and Google Play stores and/or by sending software updates (Software Push) to the User's device. The User consents to these updates and acknowledges that they may affect the manner of use of the Digital Assets, and that some services may operate only in the latest version of the application.

If other or specific terms of use apply to certain sections of the Digital Assets, they shall apply in addition to the Terms of Use detailed in these Terms.

The Terms of Use are published in Hebrew, Arabic and English for the convenience of users. In the event of any conflict or difference in meaning between the versions, the Hebrew version shall be the binding and prevailing version.

2. Governing Law and Exclusive Jurisdiction

The use of the Digital Assets is subject to the laws of the State of Israel alone. The competent courts in the city of Nazareth shall have exclusive jurisdiction in all matters relating to the Terms of Use and the use of the Digital Assets.

3. Waiver and Limitation of Liability

The information, content and services (referred to collectively as: the "Services") presented to you in the Digital Assets are provided "as is" (AS IS), and the Operator, its employees, managers, agents and anyone acting on its behalf, as well as any company or entity to which the operation or ownership of the Digital Assets may be transferred in the future, and its managers, shareholders, controlling parties, subsidiaries and anyone acting on behalf of all of these (hereinafter referred to, together with the Operator, as: "Haggz"), shall bear no liability for their suitability for your needs and/or purposes. Haggz is entitled to transfer its rights and obligations under the Terms of Use, in whole or in part, to a company or entity as aforesaid, without the need for the User's consent.

Haggz bears no liability in any manner whatsoever for Third-Party Services, nor for the use of and/or the content published in the digital assets to which the Digital Assets and/or the listings found in them refer. Any use of such digital assets shall be at your exclusive responsibility. All services provided by a third party in the Digital Assets, and any current and/or future service offered to browsers in the Digital Assets ("Third-Party Services"), including maps and places services, payment services through the two app stores, services for sending verification codes and messages, artificial intelligence services, and the services of mortgage and financing advisers, fall within the exclusive responsibility of the third parties that operate them, and Haggz shall bear no liability for any damage, loss, financial burden, non-pecuniary damage, or any other damage of any kind whatsoever that may be caused to the browser as a result of using the Third-Party Services.

Everything that appears and is published from time to time in the various sections of the Digital Assets, including expert columns of all kinds, purchasing tips, recommendations, guidance, the results of calculators (such as the mortgage calculator and the financing calculator), texts, images and translations generated or drafted with the assistance of artificial intelligence, survey data, public opinion poll data, comments, ratings and recommendations of other browsers, price comparisons, reports, articles, references to reports and/or articles, links to similar or related digital assets, and any other data of any kind whatsoever (all of which shall together be called: the "Publications") appearing in the Digital Assets, is deemed a recommendation only, and does not bind Haggz and/or impose on it liability of any kind whatsoever in relation to the actions of browsers taken in reliance on and on the basis of that recommendation. Responsibility for the content of the Publications and/or the recommendations contained in them rests with the writers and/or the publishers themselves and/or the relevant publishing bodies, each according to the circumstances of the case. Haggz shall bear no liability for any damage, loss, financial burden, non-pecuniary damage, and any other damage of any kind whatsoever caused to the browser as a result of reliance on what is stated in the Publications.

Haggz disclaims any obligation imposed on it expressly or by implication, including any liability for Third-Party Services, or interruption in the use of the Digital Assets, or the existence of viruses or destructive software or files, or the quality and accuracy of the Digital Assets and the information found in them, or fitness for any purpose, or completeness, or reliability, or compatibility and integration with the software on the User's device, and does not undertake that the use of the Digital Assets and/or the Services and/or the Third-Party Services will not be interrupted and/or will be immune to interruptions and/or faults and/or malfunctions and/or failures and/or any damage of any kind.

Haggz shall not be liable, in any case and under any legal theory (including tort liability, contractual liability, unjust enrichment, and the like), towards you and/or towards any other person, directly or indirectly, for any direct or indirect damage arising from the use of the Digital Assets and/or the Services and/or the Third-Party Services and/or due to the inability to use the Digital Assets and/or the Services and/or the Third-Party Services and/or due to a defect in the Digital Assets and/or due to loss of information and/or harm to your device and/or to the information stored on it and/or damage resulting from the total or partial deletion of stored information, and any other damage, whether such damage was foreseeable or unforeseeable. You hereby declare that you are exclusively and solely responsible for any use you make of the Digital Assets and/or the Services and/or the Third-Party Services.

It is clarified that: (a) in any case of a conflict between the text appearing in any advertisement on behalf of Haggz and the text appearing in the records of Haggz, the text appearing in the records of Haggz shall prevail; (b) with respect to any advertisement on behalf of Haggz, including promotional campaigns, Haggz reserves the right to cancel the advertisement and/or the promotional campaign and also to restrict participation in it; and also (c) no advertisement on behalf of Haggz shall be deemed a binding offer, and unless otherwise agreed between the parties, any engagement of any kind between Haggz and any third party is conditional upon the prior written consent of Haggz.

It is clarified that Haggz is not a party to any transaction, sale or rental agreement, work or employment relationship, appointment or service agreed upon between the users themselves or between a user and an advertiser through the Digital Assets, and that it does not examine and does not guarantee the identity of advertisers, their qualifications, their licences, or the truth of what they offer, even if the mark "Verified by Haggz" appears next to the advertiser, which means only that the advertiser has submitted certain documents in accordance with the procedures of Haggz.

4. Use of the Digital Assets, Publication of Listings and Listing Management Policy

The Digital Assets may include publications that cannot be edited, in whole or in part (a "listing"), as well as publications that can be edited without any restriction on editing ("advertising spaces"). The Digital Assets currently allow the publication of listings in the following sections: Services, Businesses for Sale, Real Estate (for sale and for rent) and Jobs, and any other section that Haggz may add from time to time. In addition, the Digital Assets offer free publication tracks and publication tracks in return for payment; all as detailed and in accordance with the terms set out in the Digital Assets, which may change from time to time at the absolute discretion of Haggz.

In Haggz, a search for listings may be carried out by words, by section, category and filters, and on the basis of geographic criteria, including search on the map and ordering the results by proximity to the User's location. In this context, a precise search (at the level of the neighbourhood, the street or the displayed map area) or a flexible search (at the level of the city/area/district) may be carried out. It should be noted that when a precise search is carried out, the listings that meet the search criterion will appear. Alongside this, when a flexible search is carried out, and in view of the breadth and wide scope of the results, Haggz does not undertake that all relevant listings will appear in the search results. Accordingly, Haggz will operate various algorithms for displaying the listings so that they are ordered, among other things, according to geographic proximity and date of publication, according to the level of the listing's upgrade (its promotion), including its display within the rail of sponsored listings marked with the word "Sponsored", according to the score relevant to the User's data, and at the exclusive discretion of Haggz.

The publication of listings and the manner in which they appear shall be according to the geographic location that the advertiser specifies for the listing (an address and/or a point on the map), and Haggz is entitled to divide the display of listings, and in particular real estate listings, according to predefined geographic areas, which shall be determined at the discretion of Haggz. Where a location is required to be specified for the listing, it will not be possible to publish the listing without linking it to a location or to a geographic area, in accordance with what appears in the Digital Asset. It should be noted that when a listing is linked to a particular location or geographic area, it will appear according to that location only and will not appear under other locations or areas. Each listing will be linked to one location or to one geographic area only. Haggz is entitled, at its discretion and for purposes of protecting privacy, to display to the public, in certain types of listings, an approximate location instead of the exact address.

When registering to publish in the Digital Assets, you will be asked to provide your telephone number and to verify it by a code sent to you, your name, and your email address where required, as well as additional/other personal details (for further information, please read the Privacy Policy of Haggz). These data are important to us in order to approve your listing and to communicate with you during its publication. Messages from Haggz relating to your listing may also include advertising content. Without providing the data defined in the Digital Assets as "mandatory" data, you will not be able to use the services offered in the Digital Assets, such as publishing in the Digital Assets, in whole or in part.

In addition, when downloading the application, you will be asked to consent to the use of notifications which Haggz may use in the various services offered within the Digital Assets. Without consenting to receive these notifications, you may not be able to use those services fully.

For the avoidance of doubt, in the event that you request the transfer of your details or the details of your listing in order to obtain a particular service from a mortgage adviser, a financing adviser, a real estate adviser or another expert (one or more), your details and the details of your listing will be transferred to those third parties. Likewise, when you apply for a job through the "Apply" button, your professional profile, your contact details and the CV file you attached will be transferred to the publisher of the job listing; and when you book an appointment with a service provider, your name, your telephone number and the booking details will be transferred to the service provider.

Haggz reserves the right not to approve the text of any publication that is improper and/or does not meet the standards of the Digital Assets and/or whose publication/sale is prohibited under the laws of the State of Israel. Listings are subject, before their publication and after every edit to them, to a check carried out by automated means (including artificial intelligence) and/or by the Haggz team, and such check does not constitute a guarantee or an approval of the truth or legality of the listing. Haggz reserves the right to transfer the details of the text of the publication to commercial entities and/or various entities operating in cooperation with Haggz, in accordance with its commercial obligations, even before the publication is uploaded to the Digital Assets.

Haggz is entitled to remove/change/edit any publication in the Digital Assets, in the event that it finds that such publication is published and/or displayed unlawfully and/or contrary to what is stated in the Terms of Use and/or the terms of the order, if any, and/or infringes the rights of any third party and/or on the basis of a claim by any third party that the said publication infringes its rights and/or violates any other law.

In accordance with the Terms of Use, each person is entitled to publish one publication only on the same subject, and to edit and change it throughout the period of publication. In the event that more than one publication on the same subject by the same user is found, Haggz reserves the right to remove the publication.

The possibility of contacting the telephone numbers appearing in the listings is available only from an identified (non-withheld) telephone number. Haggz is also entitled to make the display of the means of contacting the advertiser, or applying for a job, or booking an appointment, conditional upon logging in and/or verification of the User's telephone number by a code.

5. Search, Recommendations and the Use of Artificial Intelligence (AI)

Haggz uses advanced technological systems to manage communication with users and to provide personally tailored information services as detailed in the Privacy Policy.

In addition, Haggz uses artificial intelligence and machine learning technologies and advanced algorithms for the purpose of improving the user experience and providing enhanced services, including through a search service that tolerates spelling mistakes, recognises synonyms and relies on understanding the meaning of the search words, the personalisation of content and recommendations (such as "Picked for you" and "Similar ads"), and the analysis of usage patterns.

Please note that the search service relies on an algorithm that finds results according to the search words entered. The results displayed are taken only from the active listings published in the Digital Assets at the time of the search. The search engine makes an effort to match the search results, but it does not undertake to display all the relevant results existing in the Digital Assets, and partial or incorrect results may also be displayed. In parallel, Haggz offers a traditional search service that relies on search criteria defined manually (sections, categories, filters and the map).

Haggz makes available to advertisers and to users assistive tools based on artificial intelligence, including: suggesting and drafting texts for the profile, for listings and for the job seeker's profile; creating an image for the listing, which is marked with the mark "Illustration"; machine translation of listings and profiles between Arabic, Hebrew and English; and the automated checking of listings before their publication. It is clarified that the outputs of these tools are a suggestion only, and may be inaccurate or incomplete or may include what the User did not write; that the "Illustration" is not a real image of the property, the business or the service advertised; and that the machine translation may differ from the original text, and in the event of a difference the text written by the advertiser in his own language shall prevail. The User alone bears the responsibility for reviewing any text or image before publication and verifying its correctness, and everything published in his name shall be deemed content from him for all purposes. Haggz shall bear no liability for any damage arising from the use of these tools or reliance on their outputs, including for an automated decision to delay the publication of a listing or to reject it. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

6. Display of Statistical Data

In the course of the use of the Digital Assets, Haggz may display statistical data and insights to users, in relation to the listings published by them (such as the number of times the listing appeared, the number of times its page was opened, the number of clicks on the contact buttons, and their source), and by comparing them with previous periods and/or with listings having similar characteristics published by other users in the Digital Assets (referred to together hereinafter as: the "Statistical Information").

The Statistical Information is intended to give the User a general indication relating to the listings he has published, and does not constitute a declaration, an undertaking, a recommendation, a professional opinion, a binding factual representation, or a guarantee of any result whatsoever. It is clarified that the number of "contacts" counts the clicks on the contact buttons in the Digital Assets, and does not indicate that a call or an actual conversation took place or that a transaction was concluded.

The Statistical Information relies exclusively on the activity of users and the publications in the Digital Assets, as recorded in the systems of Haggz from time to time. It is clarified that this information is not based on external sources, actual transaction data, official data, or databases that are not in the possession of Haggz.

Where comparisons between listings are made, they are made on the basis of the principle of gradual matching, whereby the main characteristics with a high level of similarity between the listings are examined first, and in the absence of a sufficient sample, the comparison is gradually widened to include additional characteristics, all in accordance with the availability of the data. It is clarified that Haggz reserves for itself the discretion to update, change or modify the characteristics of the comparison, the manner in which it is carried out, and the time period from which the statistical data are collected, from time to time, without the need to give prior notice.

In the absence of sufficient statistical data in relation to a listing, no statistical information or comparisons relating to it will be displayed, and the User will deal with the ordinary interface available in the Digital Assets.

7. Publication of Paid Listings

Haggz is entitled, at its discretion, to decide that certain types of publications will be available in the Digital Assets in return for payment only, in an amount determined by Haggz from time to time, and in accordance with the track/tariff applicable to that listing at the time of publication. Without prejudice to the generality of the foregoing, the listings that are or may be subject to payment include, among other things:

• Publication on behalf of a "Business Customer", as defined below - including by Real Estate Brokers, employment agencies and manpower companies, package holders or a user classified as a business user;
• Publication of real estate or movables defined as assets for commercial purposes - including, by way of example and without limitation, the publication of offices, the publication of commercial sites, the publication of Businesses for Sale, and so forth;
• Publication of Jobs listings, Real Estate listings (for sale or for rent), and Businesses for Sale listings, for a publication period chosen by the advertiser (one month, two months or three months, or any other period determined by Haggz); as well as the publication of listings in which the asking price exceeds 200,000 New Shekels or any other amount determined from time to time at the discretion of Haggz;
• Publication by a Private Customer, in which the number of products/properties/listings that he publishes in the Digital Assets during a certain period of time exceeds the policies (procedures) of Haggz in relation to each section of the Digital Assets separately;
• A user whose volume and/or frequency of viewing and/or use of the telephone numbers and means of contact appearing in the listings in the Digital Assets exceeds the policies of Haggz.

It is clarified that publication in the Services section is currently available free of charge, and that the requirement of payment for the publication of Jobs listings, Real Estate listings and Businesses for Sale listings shall come into effect in each section on the date determined by Haggz, and shall be presented to the advertiser in the Digital Assets before publication. Where publication is paid, the advertiser is offered the choice of the publication period and payment after his listing has been approved, and payment is made by means of in-app purchase through the App Store of Apple or the Google Play store, and the binding price is the price displayed in the store at the time of purchase.

When publishing one of the categories of listings that require payment, the option of free publication will not be offered to the User. Refraining from or evading payment, where a type of publication requiring payment is concerned, is contrary to the instructions of the Digital Assets and the ways of using them. In view of the foregoing, in the event that it is found that a user is publishing in a free section with the aim of evading payment, or where it is found that a user is evading payment while he is obliged to pay, Haggz reserves the right to remove the publication immediately and to charge the User a fine and a handling fee on account of his conduct, in the amount determined by Haggz. It is clarified that Haggz is entitled, at its discretion, to update the classifications of paid listings, the free quotas, the tariffs, the eligibility conditions and the definitions from time to time, all subject to the law and to the provisions of these Terms (the Terms of Use).

The User is entitled to cancel the publication order and to receive a refund of the full amount, as long as the listing has not actually been published in the Digital Assets of Haggz (hereinafter: "Pre-Publication Cancellation").

For the avoidance of doubt, the date of actual publication shall be deemed to be the date on which the listing becomes visible to the public of browsers in the Digital Assets, and no right of cancellation shall be granted for a listing that was published and thereafter frozen (stopped). The said notice of cancellation shall be delivered to Haggz through the personal area or by contacting Haggz via "Contact us" or by email. In the event of a lawful Pre-Publication Cancellation, the full amount paid by the advertiser shall be refunded within 14 days from the date of receipt of the notice of cancellation, by the same means of payment by which the transaction was made; and where payment was made through the App Store or Google Play, the refund shall be made through the store and in accordance with its procedures.

The period of publication of listings in the Digital Assets is limited in time, at the exclusive discretion of Haggz. The time limit for the publication of listings may differ between the types of listings and the various sections of the Digital Assets, and may be updated from time to time, at the discretion of Haggz. In listings published for a paid period: the period begins on the date on which the listing becomes visible to the public; the counting of the period does not stop when the listing is paused or edited; an extension of the publication before the end of the period is added to the end of the current period; and upon the end of the period the display of the listing to the public ceases and it remains saved in the advertiser's personal area ("My listings") for its renewal. Haggz may send a reminder before the end of the period, but the failure to send the reminder or its non-arrival does not extend the period and does not confer a right to any compensation.

Without prejudice to the foregoing, Haggz is entitled to determine that the publication of a free basic listing, in all or some of the sections, will be available for a period of up to 40 days from the date of its upload (publication), and the listing will be displayed without any special priority. Within the framework of the publication of a basic listing as aforesaid, bumping (updating the position/Bump) the listing manually may be permitted at a frequency of once every 24 hours, in accordance with the settings of Haggz. The basic listing shall not include marks (badges) based on artificial intelligence and/or other dedicated marks, unless expressly stated otherwise.

Accordingly, Haggz reserves the right to remove the publication of listings that are published in the Digital Assets for a period exceeding 200 days of publication. We emphasise that extending the validity of listings that have exceeded the time limit for publication will not be permitted, except in accordance with the tracks offered by Haggz.

Use of marks (badges) - Haggz reserves the right, at its discretion, to add and/or use dedicated classification marks, which shall be updated from time to time, on the listings. In this context, Haggz may use various marks to indicate, among other things, "price reduced", "price increased", "new listing", "listing from a broker", "Sponsored", "Verified by Haggz", "Illustration", "Stopped" and others. It is clarified that the use of the marks, including the non-use of marks, as well as the position in which the marks appear in the listing, shall be based on the data entered by the User when uploading the listing and/or when updating it, and is subject to the exclusive discretion of Haggz.

Where necessary, Haggz reserves the right to contact you, during publication and throughout the period in which the publication remains in the Digital Assets, and to request ownership documents, identity documents or a licence (including through "Verification documents" in the application) in order to verify the details contained in the publication. Haggz documents the receipt of the documents in its systems but undertakes not to make any use of these documents other than carrying out the verification and proving ownership, and not to transfer them to any third party, unless it is obliged to do so by law.

You undertake not to include a link/hyperlink to another website or an internet address in the publication, whether in writing or within an image, except in the fields designated for that purpose in the Digital Assets. The telephone number shall be stated exclusively within the contact fields and not in the free text.

It is clarified that all the various services in the Digital Assets are provided to users of the Digital Assets in accordance with the terms determined by Haggz, and that access to them and their use are conditional upon meeting the basic conditions determined by Haggz. Haggz reserves the right not to approve the use of the services it offers on account of failure to meet these conditions, at its absolute discretion.

The addresses and maps database of Haggz relies on various databases, including information obtained from the maps and places services of Google. For the avoidance of doubt, the copyright and intellectual property rights in each of these databases belong to their owners, and their use is also subject to the terms of their owners.

You declare and undertake not to collect data from the Digital Assets in any manner whatsoever (other than the ordinary viewing of listings as any reasonable user) including by any technological and/or electronic and/or computerised means and/or through automated software (including spider robots (Spiders), scraping tools (Scrapers) and the like). Any other use, including contacting the publisher of the listing other than for the purpose of an interest in purchasing/renting the property/product/service published or in applying for the job published, shall constitute use contrary to the Terms of Use, with all that this entails, and Haggz reserves the right to claim appropriate compensation on account thereof.

Without prejudice to the foregoing, you declare and undertake as follows:

• Not to copy and/or reproduce and/or update and/or change and/or distribute and/or publish to the public any content found in the Digital Assets.
• Not to take any action that creates and/or may create a load on the systems and servers of the Digital Assets.
• Not to take any action that interferes with and/or disrupts (and/or attempts to interfere with and/or disrupt) the normal manner of operation of the Digital Assets and the Services.
• Not to circumvent or attempt to circumvent any technological measure found in the Digital Assets and/or in the systems connected to them, whose function is to prevent any of these activities prohibited under the Terms of Use.

It is hereby clarified that the Digital Assets constitute an advertising platform for browsers/users, and that Haggz is not responsible for the content of the listings and/or the advertising spaces published within them, and that responsibility for the content appearing in the listing rests with the advertiser alone. Nevertheless, the policies of Haggz prohibit publications whose subject matter is unlawful and/or offensive.

For the avoidance of doubt, it is hereby clarified that listings may not be published in the Digital Assets for the sale/marketing/rental/supply/publication/distribution of products and services that are contrary to the law. Haggz shall bear no tortious or criminal liability as a result of such publication or of responding to it. Haggz also reserves its right to approach, where necessary, the law enforcement authorities in order to prevent the continued publication of products/services as stated in the Terms of Use, while disclosing the details of the advertiser.

Without prejudice to the generality of the foregoing, you undertake not to publish and/or enter into the Digital Assets one or more of the following contents:

• Any material that harms or infringes the proprietary rights of others, or distorts the rights and/or content of third parties, and/or infringes the copyright of a third party - including intellectual property rights such as copyright or trademarks. Such material includes, by way of example and without limitation, music files (such as MP3 files), protected computer software, means of circumventing, removing or disabling digital protection on computer software and files of all kinds, protected images and films, transcribed texts, musical scores, texts or works of art created by others.
• Any pornographic material or material of an explicit sexual nature, which violates the provisions of any law or may offend public sensibilities.
• Any material relating to minors without obtaining the consent of the legal guardians and which identifies them as minors or includes their personal details or their addresses and the means of contacting them.
• Any sensitive security information, or other information that is sensitive by its nature.
• Any computer program, computer code or application containing a computer virus, including the malicious software known as Trojan horses (Trojan horses), worms (Worms), vandals (Vandals), malicious applications (Malicious Applications) and the like.
• Passwords, usernames and other details that enable the use of computer software, digital files, websites or services that require registration or payment, without payment or registration as aforesaid.
• Any unlawful material, or material that encourages, supports, assists, provides instructions for carrying out, or guides the carrying out of an act that constitutes a criminal offence under the laws of the State of Israel.
• Any material that constitutes libel and defamation of any person.
• Any material that discloses the personal or intimate details of any person (including his name), without his having provided them himself, and/or material that violates the privacy and/or the sanctity of the private life of any person.
• Matters in respect of which there is a publication ban order issued by the courts.
• Any material of a harassing, offensive, hostile, threatening, obscene or racist nature or content that offends public sensibilities. Any material and/or messages that may harass and/or offend other users, including within the framework of the messages sent through the Digital Assets and/or the Services (such as job applications, appointment booking notes and "Contact us" messages) and SMS messages.
• Any material that is contrary to the accepted rules of use on the internet or that may cause damage to or offend internet users in general, and the customers of the Digital Assets in particular.
• Any job listing or condition of acceptance that involves discrimination prohibited by law (including on grounds of sex, age, religion, nationality, country of origin or disability), and any listing that is false, misleading or impersonates another person or body.

Haggz reserves the right to block/cancel/remove any publication (listing) that does not comply with the provisions of the Terms of Use and/or the provisions of the law and/or the policies of Haggz and/or which is liable to offend any person or other legal entity and/or the circumstances of whose publication are connected, directly or indirectly, with a fraudulent act or with any other prohibited act; all of this, whenever the occurrence of such violation comes to the knowledge of Haggz.

Haggz also reserves the right to block/cancel/remove any listing and also to withhold any other service from an advertiser who has an unpaid debt to Haggz and/or if Haggz has monetary and/or other claims against him (even if such claims are not connected with the listing).

It is clarified that the Digital Assets contain various sections with various types of listings. Accordingly, the User must ensure that his listing is published under the relevant section and category, failing which Haggz reserves the right to move the location of the listing or to remove it.

In addition, it is clarified that viewing the telephone numbers and means of contact appearing in the listings published in the Digital Assets in volumes and/or at a frequency exceeding those defined in the policies of Haggz is deemed commercial use of the Digital Assets, which requires payment. Refraining from or evading payment in cases where the use is commercial and requires payment as stated above is contrary to the provisions of the Digital Assets and the ways of using them. Accordingly, if it is found that a user is evading payment as aforesaid in the cases in which he is obliged to pay, Haggz reserves the right to block the service from him, such that he will not be able to contact the numbers appearing in the listings.

Nothing in the foregoing or in what follows obliges Haggz to act in the manner stated above, and in all cases and circumstances Haggz shall not be liable for any damage caused to any party as a result of the taking of action or the failure to take action on the part of Haggz in this context.

The advertiser undertakes to indemnify Haggz for any damage, loss, liability, expenses and loss of income caused to it as a result of a claim and/or demand directed at it by any third party, the cause of which is connected, directly or indirectly, with the publication of the content of the listings published by the advertiser, including as a result of an infringement of a proprietary right, the good name, or the privacy of any third party and/or a violation of any law.

8. Copyright and Intellectual Property

Haggz owns the copyright and the intellectual property rights in the Digital Assets and the trademarks associated with them, exclusively. The scope of the copyright and intellectual property rights includes, among other things, the graphic design of the Digital Assets, the structure of the Digital Assets, their formal and substantive components, the texts appearing in them, the publications, the listings published in the Digital Assets, as well as the files, applications, software code and databases of any type and kind.

Accordingly, Haggz owns all the rights in the name "Haggz" and "حجز" and in the Haggz logo, whether registered or not, and has filed an application to register the trademark "Haggz" with the Registrar of Trademarks in Israel (trademark application no. 394042).

It is strictly prohibited to copy, distribute, display, publish or transfer the foregoing or any part of it, including any listing appearing in the Digital Assets (whether in the application and/or on the website or anywhere else in the Digital Assets), unless the prior written consent of Haggz to this has been obtained. This prohibition does not apply to sharing a link to a listing by means of the share button available in the Digital Assets.

It is hereby clarified that by accepting these Terms of Use, everyone who publishes a listing in the Digital Assets transfers to Haggz all the intellectual property rights relating to that publication, including the content of the listing and the images included in it, including the copyright and the rights to sue for any infringement of these rights. To the extent that the said transfer of rights is not possible or effective under the law, the advertiser grants Haggz a non-exclusive, free-of-charge licence, unlimited in duration or place and transferable, to use the content of the listing and its images, and to copy, display, translate, edit and publish them in the Digital Assets and outside them.

It is hereby clarified that any image uploaded to the Digital Assets by the customer/advertiser and not by Haggz is under the responsibility of the advertiser alone, as is any image or text created at the request of the advertiser by means of the artificial intelligence tools available in the Digital Assets and which the advertiser chose to publish.

Haggz shall bear no liability for any damage of any type and kind relating to intellectual property or otherwise which is infringed as a result of an unauthorised publication of an image/drawing or any other element that is the subject of copyright or any other proprietary right. Haggz reserves the right to remove any infringing publication as aforesaid whenever the occurrence of the infringement comes to its knowledge.

It is clarified that for the purpose of preventing copying from the Digital Assets, Haggz is entitled to stamp (imprint) a distinctive watermark and the Haggz logo on any image/images/drawing or any other visual means published attached to any listing, and to add to the images marks such as "Illustration".

9. Cancellation of Transactions

In any case in which there is a written contract (in writing) between you and Haggz, the cancellation provisions set out in that specific contract shall apply.

In any other case, the provisions of the law shall apply to the cancellation of the transaction. In this context it should be noted that, in any case in which paid listings (publications) in the Digital Assets are cancelled before the end of the relevant publication period, the advertiser shall not be entitled to any refund and Haggz shall not be obliged to compensate the advertiser in any amount. The foregoing shall apply accordingly to any other service provided for consideration within the Digital Assets which is cancelled by the user/browser, including the "Sponsored Listing".

Where payment was made by means of in-app purchase through the App Store or Google Play, requests for cancellation and refund shall be submitted to the store through which the payment was made and in accordance with its terms and procedures, and in the event that the store refunds the amount, Haggz is entitled to cancel the period or the service purchased or what remains of it. Refunds for «Haggz credits» packs are governed by clause 16.11 and by the "Cancelling a Transaction" page. Nothing in the Terms of Use derogates from a right granted to the consumer under a law that may not be contracted out of.

10. Continuous Operation of the Digital Assets

Haggz does not undertake to operate the Digital Assets in their current format for a defined or fixed period of time. Haggz reserves the right to make structural and substantive changes to the Digital Assets as it sees fit, including the locations of the listings (publications) in the Digital Assets, and to cancel, add, change and update all the functions existing in them, at any time. Any interruption in the continuous and proper operation of the Digital Assets, due to the carrying out of repairs, changes and improvements, shall not constitute grounds for any claim, allegation or demand on your part. Haggz, for its part, makes and will continue to make its best efforts so that you are able to browse and use the Digital Assets continuously and permanently, but it does not undertake that there will be no disturbances, faults or interruptions relating to and connected with the operation of the Digital Assets and what accompanies such operation.

Haggz reserves the right, in accordance with its policies and at its exclusive discretion alone, to decide on the nature and content of the commercial advertisements, as well as the placement of such advertisements, including visual, audio or pop-up advertisements or advertisements of any other type, in any part or section of the Digital Assets, and it shall not be subject to any restrictions regarding the nature or manner of the advertising. It is hereby clarified that Haggz may place the commercial advertisements within the spaces of the listings uploaded by users in the Digital Assets (including the listings of Business Customers and/or listings published for consideration), without this conferring on the publishers of the listings a right to any consideration or compensation, and this even if the commercial advertisement promotes a service that competes with the service offered by the publisher of the listing, or belongs to a commercial competitor of his, or is contrary to the values or taste of the publisher of the listing. It is also clarified that Haggz may link the content of the listings published in the Digital Assets with the nature or subject of the commercial advertisements, the sponsored listings or the "Similar ads" that will be placed near them or within them, at its exclusive discretion and without any prior notice to the publisher of the listing.

11. Notice and Takedown

In cases where you find that any listing (publication) uploaded by any third party offends and/or violates the provisions of the law, including your intellectual property rights, you may report such violation by means of the "Report this listing" button that appears in every listing, or in writing through "Contact us" in the Digital Assets, or by email at haggz.company@gmail.com. Haggz undertakes to examine such approach (request), including with the publisher of the listing, and to remove it from the Digital Assets if necessary.

12. Business Customers

In this chapter, the following terms shall have the meanings assigned to them:

"Advertising Means" - the publication of listings, the promotion of listings (including the "Sponsored Listing"), and/or the advertiser's public page (the mini-site / Mini-site) only.

"Business Customer" - a Business Customer is one of the following:

1. A Private Customer (an individual) whose quantity of products / properties / listings that he publishes in the Digital Assets during a certain period of time exceeds the policies of Haggz in relation to each section of the Digital Assets separately.
2. A user whose quantity and/or frequency of viewing and/or use of the telephone numbers and means of contact appearing in the listings in the Digital Assets exceeds the policies of Haggz.
3. Any individual, partnership or corporate entity of any kind (including a Real Estate Broker, an employment agency and a manpower company) (a) whose business (whether directly and/or indirectly) consists of retail trade, wholesale trade or small-scale trade, direct or indirect, in products and/or services; and/or (b) any corporate entity (including a partnership and/or a company and/or any other type of entity that is not an individual) that publishes listings for the sale and/or rental of products and/or services (including the rental and/or sale of real estate) and/or Jobs listings.

It is emphasised that Haggz reserves the right to determine the definition of an individual user as a "Business Customer", according to the manner and frequency of use at the level of the user account and/or the contact details appearing in the user account and/or additional data, even if the User uses the platform on behalf of other parties (bodies).

"Private Customer" - anyone who is not deemed a Business Customer.

"Real Estate Broker" - independent (private) brokers and/or brokerage agencies and/or companies of any kind and/or other business owners whose business consists of real estate brokerage and/or the publication of listings on their behalf / in their name.

The policy for managing Advertising Means for Business Customers, without prejudice to the other provisions of the Terms of Use, and where applicable, mutatis mutandis, is as follows:

12.1 Unless expressly stated otherwise in the Digital Assets or in the Terms of Use (as in the Services section, which is currently available for publication free of charge), any use of the Digital Assets within the framework of and/or in direct or indirect connection with a commercial business is subject to the signing of an agreement with Haggz and to payment, and may not be carried out without obtaining express approval from Haggz and the Business Customer's consent to the contractual terms of Haggz; and this whether within the registration procedures for the relevant service in the Digital Assets or through the channels of communication with Haggz detailed above.

12.2 Haggz is entitled to determine that the publication of listings in the various sections of the Digital Assets, all or some of them, by Business Customers shall be for consideration (paid) only, and where this has been determined, any such publication made without payment shall be stopped immediately and without any prior notice, without prejudice to the remedies (compensation) available to Haggz in connection therewith. Payment for the publication of listings in the Digital Assets shall be made in accordance with the exclusive policy of Haggz, which may change from time to time.

12.3 When purchasing Advertising Means - whether in the Digital Assets or through direct contact with Haggz - you will be asked to consent to the terms of purchase presented at the time of purchase and/or to sign a contract for the purchase of Advertising Means with Haggz.

12.4 The Business Customer is entitled to cancel the contract for the purchase of Advertising Means by sending Haggz a written notice of cancellation of the order, duly signed by the customer, in accordance with the terms set out in the advertising order which he is asked to sign or to consent to when purchasing the Advertising Means.

12.5 In the event that the Business Customer's credit card or other means of payment is declined and the payment is not made on its due date, the Business Customer hereby gives his prior consent that this shall result in the imposition of a late-payment charge at a rate equal to the rate of exceptional default interest published by Bank Leumi le-Israel, without prejudice to any other remedy or right granted to Haggz under any law.

12.6 Haggz is entitled at any time to change the prices, the packages and the other terms of engagement with its Business Customers. Such a change shall not result in a change to the terms of Advertising Means that have already been sold.

12.7 The content of the Advertising Means shall include the details of the property / product / service / business / job only, as well as the details of the commercial business to the extent that these are required solely for the purpose of carrying out the relevant purchase or engagement, and the Business Customer confirms and declares that the content of the Advertising Means that will be published by him does not and will not violate the provisions of any law and/or the rights (including intellectual property rights) of any third party.

12.8 The Business Customer acknowledges that he is aware that Haggz is entitled, at any time, not to approve an unlawful listing or Advertising Means and/or to make the approval of publication subject to conditions and/or to withdraw the approval granted for publication at any time, if it finds that such listing is published and/or displayed unlawfully and/or in a manner contrary to what is provided in the Terms of Use and/or to the terms of the order, if any, and/or infringes the rights of any third party and/or on the basis of a claim by any third party that the said listing infringes its rights and/or contravenes another law, and he confirms and declares that Haggz shall bear no liability for any damage and/or loss and/or expenses incurred by the Business Customer, directly or indirectly, as a result thereof.

12.9 It is known to and agreed by the Business Customer that Haggz is entitled to remove the content of the listing or the Advertising Means temporarily due to a fault in the Digital Assets and/or in one of their sections and/or in the event that they do not function properly in such a case. Furthermore, Haggz is entitled to remove the content of the listing or the Advertising Means immediately, if it finds that the said content is not published and/or not displayed lawfully and/or is in a manner contrary to what is provided in the Terms of Use and/or infringes the rights of any third party and/or on the basis of a claim by any third party that the said content infringes its rights. The Business Customer shall have no claim against Haggz regarding the foregoing.

12.10 As of the date of the Business Customer's consent to this offer, the agreement between the parties shall apply and shall be subject to the terms and conditions of use, and any change or addition not approved in writing by both parties shall not be valid.

12.11 A listing belonging to a Business Customer which is published so that it appears as if it were a listing on behalf of a Private Customer (including listings of Private Customers intended to direct those who respond to the listing to a Business Customer) and in respect of which payment has not been transferred as stated above - shall be removed from the Digital Assets without any prior notice, without prejudice to the remedies (compensation) available to Haggz in connection therewith. It is clarified, as stated above, that any attempt at evasion of this kind shall result in the imposition of a fine and a handling fee by Haggz in the amount determined by Haggz.

12.12 The publication of Advertising Means or any other use by a Business Customer in the Digital Assets (including a listing on behalf of and/or in the name of a Business Customer, as well as a listing of a Private Customer intended to direct the users who respond to the listing to the Business Customer) which appears as a private / personal listing / use, shall be removed / stopped immediately and without any prior notice, without prejudice to the remedies (compensation) available to Haggz in connection therewith. Without derogating from the foregoing, Haggz is entitled, at its own discretion, to remove Advertising Means that are deemed to be a double (duplicate) listing on behalf of the same Business Customer.

12.13 In cases of a change of circumstances and/or the passage of time, the User may approach Haggz to request a review of the extent to which he fits the definition of a Business Customer. It is emphasised that in all cases, the definition of the User and/or the user account is subject to the exclusive discretion of Haggz.

12.14 Haggz reserves the right to cancel Advertising Means whose content includes self-promotion (self-advertising) of any kind without prior notice. It is clarified that in the event of the removal of such Advertising Means, the amount paid for them shall not be refunded to the Business Customer. Nevertheless, the Business Customer shall be given the opportunity to publish the Advertising Means again until the publication period of the Advertising Means that was paid for has been exhausted, after removing all the details that constitute self-promotion and obtaining the approval of Haggz.

12.15 Haggz is entitled, at its exclusive discretion, to offer from time to time to all or some of the customers discounts, promotional campaigns or various benefits (including free publication periods) on the advertising products sold through the Digital Assets, in whole or in part, for a limited period and subject to the conditions it determines.

12.16 The rate of the discount, its duration, its scope, the conditions of eligibility for it, the recipients of the offer, the range of products to which it will apply, and the Digital Asset in which it will be offered, may change or be discontinued, at the discretion of Haggz, and without any prior notice. No double discounts or double benefits shall be granted, unless expressly stated otherwise.

12.17 The Business Customer is aware that Haggz does not permit the purchase of a package or the use of an account jointly with another customer, such as a broker/brokerage office/employment agency/other business owner. The Business Customer is also aware that if it is found that he is sharing a package or an account with another customer, Haggz is entitled to cancel his order immediately and to fine him in the amount of five thousand (5,000) Shekels.

12.18 It is hereby clarified that Haggz is not and shall not be liable for any damage, of any type or kind, caused to the Business Customer in connection with the use of the Digital Assets. The Business Customer undertakes to indemnify Haggz for any damage, loss, liability, expenses or loss of income that may be caused to it as a result of any claim and/or demand directed at it by any third party, the cause of which is connected, directly or indirectly, with the publication of the Advertising Means ordered by the Business Customer, including due to an infringement of a proprietary right, the good name, or the privacy of any third party and/or a breach of any law. Without derogating from the foregoing, Haggz will inform the Business Customer of any such claim, and will allow him to participate in the conduct of the defence.

12.19 Haggz reserves the right to verify at any time and by any means it sees fit whether the Advertising Means published in the Digital Assets by any of the parties (bodies) mentioned in this chapter comply with all the provisions of the Terms of Use, and to act in accordance with the rights and powers granted to it whether under this chapter or under the Terms of Use as a whole.

12.20 In listings published by Real Estate Brokers, where the broker is given the possibility of indicating that the property he is advertising is published on an exclusive basis, or if the broker stated this in the text of the listing, the Real Estate Broker declares that the details he provides are correct, undertakes to provide the exclusivity agreement which he signed with the owner of the property (scanned) upon the request of Haggz, and is aware that he will be fined in the amount of five thousand (5,000) Shekels in the event that his declaration is found to be false. In addition, if the broker's declaration is found to be false, Haggz reserves the right to resort to legal proceedings against the Real Estate Broker concerned.

12.21 In the event of a breach of any of clauses 12.7, 12.11, 12.12, 12.14 and 12.17 above, Haggz reserves the right to cancel the package of Advertising Means purchased by the customer immediately without returning the money to the customer. Haggz also reserves the right to resort to legal proceedings and/or not to renew the engagement with the customer.

13. Advertising in the Businesses for Sale Category and/or Commercial Real Estate

When advertising in the Businesses for Sale category and/or in the commercial real estate category, you will be asked to consent to the terms of purchase presented at the time of purchase and/or to sign a contract for the purchase of Advertising Means with Haggz.

As of the date of the purchase of the advertising space (the publication period) in the Businesses for Sale category and/or in the commercial real estate category and the publication of the listing, the product shall be deemed to have been performed (used) and cannot be cancelled, and no full and/or partial refund shall be granted in respect of it.

The party ordering the listing acknowledges and declares that the content of the listings that will be published by him, including the financial data of the business (such as sales turnover, profits, rent and number of employees), is correct and does not and will not violate the provisions of any law and/or the rights (including intellectual property rights) of any third party. The foregoing does not derogate from the provisions of the Terms of Use relating to the removal of content by Haggz.

The party ordering the listing undertakes to indemnify Haggz for any damage, loss, liability, expenses or loss of income that may be caused to it as a result of any claim and/or demand directed at it by any third party, the cause of which is connected, directly or indirectly, with the listings and/or their content ordered by the party ordering the listing, including due to an infringement of a proprietary right, the good name, or the privacy of any third party and/or a breach of any law.

14. Listings Relating to Animals

Haggz has chosen not to contribute to the illegal trade in dogs and in other animals via the internet. The Digital Assets do not currently include a section for the sale of animals, and the "Pets" category in the Services section is designated for services only (such as veterinary medicine, training, grooming and boarding), and may not be used for the sale of animals or for handing them over. For this purpose, and in order to improve the service, Haggz is entitled to use the services of an external verification body, such as the "Israel Kennel Club" (hereinafter referred to as: the "Club").

In the event that Haggz in the future makes it possible to publish listings for the sale of dogs or animals and you request to publish such a listing, you will be asked to enter the identifying details of the animal, including the names of its parents and the registration (registry) numbers granted to them. These details will be transferred, with your consent, to the Club for the purpose of verifying the listing and approving it.

It is clarified that the criteria for approving the listing in relation to the identifying details of the animal are those of the Club alone. Haggz shall not be liable, in any case and under any legal theory whatsoever (including torts, contracts, unjust enrichment, and so forth), towards you and/or towards any other person, directly or indirectly, for any direct or indirect damage arising from your consent to the transfer of the details to the Club and from the decision of the Club regarding this request of yours, and connected with the use of the Digital Assets and/or the Services and/or the Third-Party Services and/or due to the inability to use the Digital Assets and/or the Services and/or the Third-Party Services, and for any other damage, whether the damage was foreseeable or unforeseeable, and you hereby declare that you are exclusively responsible for any use you make of the Digital Assets and/or the Services and/or the Third-Party Services. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

15. Legislation (Laws)

The various sections of the Digital Assets are subject, alongside the Terms of Use of the Digital Assets, to specific laws. In some cases, these concern directions on how to act and when it is permitted to purchase products or to provide services of the type published in that category, and in other cases, publication on these subjects is prohibited just as their sale is prohibited by law. It is incumbent on you, as a user of the Digital Assets, to review the relevant laws and to act in accordance with the law.

Haggz reserves the right not to publish listings in certain categories or to remove them as detailed above.

If you come across a listing that violates any law – inform us by making contact from within the listing itself via the "Report this listing" button that appears in every listing.

16. Services and Products

Haggz offers, within the Digital Assets, various services, the main ones of which shall be detailed below. Haggz reserves the right to discontinue these services and/or to change them at any time, as needed and without prior notice.

Registration for the services detailed below shall not be deemed a derogation from the other provisions of the Terms of Use, and in every case in which a listing is removed due to a violation of the Terms of Use, the advertiser shall not be entitled to a refund of any amount.

Any use of one of the services detailed below in a manner contrary to the provisions of the Terms of Use and/or the provisions of the law shall entitle Haggz to take one or more of the remedies (sanctions) provided in the Terms of Use, including blocking your use of the said service, transferring your details to third parties in accordance with any law, and the like, without derogating from any other remedy or right available to Haggz under any law.

Haggz reserves the right to discontinue the services detailed below, in whole or in part, at any time, at its exclusive discretion and without prior notice. In the event that the discontinued service was a paid service, the User shall be charged only for the services actually provided to him.

Haggz will make its best efforts to provide the services detailed below as correctly and accurately as possible and in accordance with what the browser requests, in cases where the browser is given the choice. Nevertheless, Haggz does not guarantee that the services will in fact be provided as requested. Errors, defects or lapses in the services mentioned below cannot be prevented. Haggz will do everything in its power to enable the proper operation of each of the services. At the same time, Haggz shall bear no liability for any direct and/or indirect damage caused to the User and/or to a third party as a result of the operation and/or discontinuation of any service and/or as a result of disturbances and/or faults relating to any service. Accordingly, you shall have no allegation, claim or demand against Haggz regarding faults in the provision of the services. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

For your convenience, we set out below details of the various services that are available or that may be made available in the Digital Assets:

16.1 Payment for Services in the Digital Assets

In the Digital Assets, there is a security system in accordance with strict standards of the type described below. All the parts in which personal information is entered are transmitted over an encrypted connection (HTTPS) using SSL/TLS technology. The SSL/TLS protocol is a global standard that enables the encryption of the information passing between the server and the User's device (but it is clarified that Haggz is entitled to replace the provider of the encryption certificate or the technology at any time and without giving any notice). In addition, payment for the paid services in the application is made by means of in-app purchase, and the payment and clearing mechanism is secured, protected and operated by Apple (the App Store) and/or Google (the Google Play store), and Haggz does not receive and does not store the details of your credit card or means of payment; and Haggz verifies the completion of the purchase with the store before activating the service (but it is clarified that Haggz is entitled to replace this provider or to add other payment and clearing providers at any time and without giving any notice).

16.2 "Upgrade (Bump) of Haggz Listings"

The upgrade (bump) of the listings displayed to browsers in the Digital Assets is a paid product that Haggz is entitled to offer, and it enables the "bumping" of the listing in the Digital Assets. Where this product is offered: for a Business Customer, the bump will be carried out automatically every 4 hours, whereas a Private Customer who has purchased the service will be able to bump the listing after at least 4 hours have passed from the time of the previous "bump". The bumping of listings is limited to a limited number of listings per browser, as determined by Haggz from time to time.

16.3 Highlighting (Featuring) Listings - "Sponsored Listing"

Highlighting the listing ("Sponsored Listing") is the purchase of a prominent listing that enables the promotion and highlighting of the listing, by displaying it within the rail of sponsored listings marked with the word "Sponsored" on the page of the section to which the listing belongs. The highlighting creates prominence for the listing compared with the non-highlighted listings in the Digital Assets, but it does not guarantee a particular position, or a particular number of views or approaches, or any other result. Various packages are available reflecting different advertising periods (such as 30, 60 or 90 days). Highlighting is available for a published listing only, and it is a product separate from the payment for the publication itself and does not replace it. A prominent listing may be frozen (stopped), but the meaning of the freezing is the removal of the listing from display (airing) only. The freezing of the listing does not affect the expiry of the highlighting. That is, the expiry date of the highlighting shall remain as it is despite the freezing.

16.4 Telephone Numbers and Virtual Numbers

The listings display telephone numbers that have been verified by a code and are linked to the advertiser's account. A virtual number is a telephone number that looks ordinary, has no permanent link to a particular telephone device and is registered in the ownership of the operator. The use of the virtual number enables the publisher of the listing not to reveal his real number in the display of the Digital Assets. Haggz is entitled to determine that, within the use of the Digital Assets, there are certain areas or services in which the use of the virtual number is mandatory and a condition for activity, as well as other areas or services where you may use your personal telephone number. It is clarified that in the event that a virtual number is used (whether as an obligation, as a default option or as a choice), the virtual number will appear in your listings, in the display of the Digital Assets, and will replace your telephone number. It is emphasised that in all cases, your telephone number which you chose to display in the listing shall be deemed public information in accordance with the Privacy Policy of the Digital Assets, such that it shall be transferred, among other things, to third parties in accordance with these Terms and the Privacy Policy of Haggz and shall be used by Haggz as if it were public information.

16.5 Mortgage and Financing Calculators, Requesting a Mortgage Offer, and Real Estate Information and Indices

The real estate and financial information services in the Digital Assets enable browsers to find information that is useful to those who plan and wish to purchase a property or a business or to move to an apartment (a home), including a calculator for estimating the monthly mortgage instalment, a calculator for financing the purchase of a commercial business, the possibility of requesting a mortgage or financing offer from an external adviser, as well as any information that Haggz may display about real estate prices, demographic and economic data about the surrounding environment, nearby places, bills, professionals (tradespeople) for the moving period, and so forth (referred to together as: the "Real Estate Index").

It is hereby clarified and emphasised that the Real Estate Index is based on information and data published by official bodies, such as the Bank of Israel (in relation to the interest rate), the Central Bureau of Statistics and the Tax Authority, as well as the data collected by Haggz from other third parties (such as the places services of Google). This information and these data (referred to together as: the "Real Estate Index Data") are provided within the Real Estate Index on an "as is" (AS IS) basis, as taken from the various sites/bodies.

It is hereby emphasised, taking into account the wide scope of the said service, that the service may include erroneous or distorted information or data. The results of the calculators are a general arithmetical estimate that relies on the figures entered by the User and on general assumptions, and do not constitute an offer, an approval of a loan, financial advice or mortgage advice.

The Real Estate Index Data appear in the said service and at the same time are displayed in the Digital Assets, as part of the information displayed in the listings published in the Digital Assets.

In all cases and circumstances, Haggz bears no responsibility for the accuracy, correctness or completeness of the Real Estate Index Data and no liability shall be imposed on it or on anyone acting on its behalf in relation to the said service, or the inaccuracy, incorrectness or incompleteness of the Real Estate Index Data, and any reliance by the browser on such information shall be at his exclusive responsibility only. In all cases and circumstances, the service and its data should not be regarded as the giving of any recommendation by Haggz.

Within the framework of the foregoing, Haggz shall not be responsible for the products, services, information or offers presented in the Digital Assets, and bears no responsibility for the manner of use of these products and/or services and/or information and/or offers in the Real Estate Index and/or the Real Estate Index Data or for their suitability for your needs. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

When you send a "mortgage offer" request or a financing request from within a listing, you will be asked to give two consents: to receiving marketing approaches, and to the transfer of your details and the details of the request to an external mortgage adviser or financing adviser, who may also contact you himself. The services of such adviser are a third-party service, and Haggz is not a party to any engagement between you and him and is not responsible for his offers or for their results.

Within the framework of the Real Estate Index, Haggz is entitled to offer also a mailing service (by email, text messages, WhatsApp or application notifications) that provides financial, statistical and other data, weighted (combined) with appraisal (appraisers') data and statistical samples regarding real estate assets in the area defined by the browser using the mailing service (the "Mailing Service").

The Mailing Service requires active registration for the service and consent to receiving the mailings.

It is hereby clarified and emphasised that the Mailing Service is based, among other things, on information and data published by the Central Bureau of Statistics, the Tax Authority and the Bank of Israel, as well as the data collected by Haggz from other third parties. This information and these data (referred to together as: the "Mailing Service Data") are provided within the Mailing Service on an "as is" (AS IS) basis as taken from the various sites/bodies. It is hereby emphasised, taking into account the wide scope of the Mailing Service and the fact that this service gathers a wide range of parameters for its calculation and its division into areas, which are taken into account in determining the prices, that the Mailing Service may include erroneous or distorted information or data (including errors in the transmission of the information, or the processing of the data, or its presentation, or clerical errors, or incorrect market data, and so forth). For the avoidance of any doubt, such defects may also appear within the supplementary information on real estate assets provided as part of the Mailing Service, whenever it is provided (such as information about the educational and health institutions located in the area, demographic data, data relating to previous transactions carried out in the area, etc.).

All the prices and other data (including the Mailing Service Data) appearing in the Mailing Service are in the nature of a recommendation only.

In all cases and circumstances, Haggz bears no responsibility for the accuracy, correctness or completeness of the Mailing Service Data, nor is it responsible, directly and/or indirectly, for any damage, direct or indirect, caused to any user as a result of the use of the Mailing Service (including any economic, physical, emotional or other damage), and the responsibility rests with the user of the Mailing Service alone. Accordingly, you shall have no allegation, claim or demand against Haggz regarding the Mailing Service. Transactions may not be carried out in absolute reliance solely on the Mailing Service Data, and any such reliance by the browser on such information shall be at the responsibility of the browser alone. In all cases and circumstances, the Mailing Service and the Mailing Service Data should not be regarded as the giving of any recommendation on the part of Haggz.

Any mention of professionals (tradespeople) and external parties within the Mailing Service or within the Real Estate Index (including real estate appraisers, lawyers, accountants, brokers, mortgage advisers, renovation contractors, etc.) does not constitute a recommendation on the part of Haggz to use their services, and Haggz shall not be responsible for any commercial engagement between users and the said external parties.

Naturally, the prices appearing in the Mailing Service refer to the price level in an area and not to a particular (specific) property. Haggz recommends that each user carry out an individual (detailed) examination of the property concerned (including by cross-checking the Mailing Service Data against the data provided by other parties and consulting professionals, appraisers and lawyers), and the results and consequences of not carrying out such an examination shall fall on the User alone. The images in the Mailing Service are for the purpose of illustration only.

Haggz and all those involved, directly or indirectly, in determining the prices in the Mailing Service are entitled to change any detail in the content of the Mailing Service and the detailed information, including the price, without giving any notice. Haggz reserves the right to discontinue the Mailing Service or to change its terms at any time at its exclusive discretion and without prior notice.

By registering for the Mailing Service, or by giving consent to receive marketing approaches in any form in the Digital Assets, you express your wish and give your consent that Haggz and/or anyone acting on its behalf may use the information, in accordance with any law, including sending general information from Haggz, including updates, articles, advertising and marketing information and/or offers to purchase various services or products, by email and/or text messages and/or WhatsApp and/or application notifications and/or automated dialing systems. By using the Mailing Service, you give your consent to the Terms of Use and your consent to receive "advertising material" as defined in Amendment No. 40 to the Communications (Telecommunications and Broadcasting) Law, 5742-1982, as well as your consent under the Protection of Privacy Law, 5741-1981. You may remove yourself from the Mailing Service and stop receiving emails, text messages and information by clicking on the link appearing in the message sent to you and/or through the "Contact us" form found in the Digital Assets. It is emphasised that all the provisions of the Terms of Use relating to the manner in which Haggz uses browsers' information and the transfer of information about browsers to advertisers and other third parties shall also apply to the information collected within the Mailing Service.

Haggz will make its best efforts to enable the proper operation of the Mailing Service. At the same time, Haggz does not guarantee the availability of the Mailing Service and shall bear no liability for any direct and/or indirect damage (including any economic, physical, emotional or other damage) caused to the User and/or to a third party as a result of the operation and/or discontinuation of this service and/or as a result of disturbances and/or faults relating to this service (including the unavailability of the Mailing Service and/or the provision of inaccurate data within the Mailing Service). Accordingly, you shall have no allegation, claim or demand against Haggz regarding the Mailing Service. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

16.6 Contact Between Users: Calling, WhatsApp, Applying for Jobs, Booking Appointments and Chat

The Digital Assets enable direct contact between the publisher of the listing and the interested browser, by means of the telephone call and WhatsApp buttons, by means of the "Apply" service (sending a professional profile and a CV to the publisher of a job listing), by means of the service for booking appointments with service providers, and by means of a chat service integrated in the Digital Assets if Haggz activates it (referred to together as: the "Contact Services"). The responsibility for the use of the Contact Services rests with the User alone and is at his exclusive discretion.

For the purpose of operating the Contact Services, Haggz uses third-party services (such as telephone companies, the WhatsApp application and providers of message and notification delivery). Haggz and/or anyone acting on its behalf is not a party to the communication and/or to the content of the conversations, and is not a party to any employment relationship, appointment or transaction arising from it. Haggz is not an employment agency and not an employer, and does not guarantee a response to any job application or its acceptance, and does not guarantee the attendance of any party at an appointment or the performance of the service. Where payment is made for a service for which an appointment was booked, the payment is made directly between the User and the service provider, and Haggz does not receive these funds and is not responsible for them.

Haggz and/or anyone acting on its behalf does not have sight of the content of the telephone calls and WhatsApp conversations conducted outside the Digital Assets and has no possibility of accessing such content. By contrast, what is sent through the Digital Assets themselves, such as job applications, the professional profile, the CV file, the appointment booking details and the chat messages if activated, is stored in the systems of Haggz, for the purpose of operating the service and in accordance with the Privacy Policy. The CV file is kept in storage that is not accessible to the public, and is displayed through the Digital Assets only to the applicant and to the publisher of the job listing to which the application was submitted.

Upon your activation and use of the Contact Services, you agree that Haggz may send you mailings and/or messages and/or notifications relating to the items you have published and/or about which you made contact and/or the messages and requests sent to you.

16.7 Sharing a Listing and Share Links (Including on Facebook and WhatsApp)

The sharing service in Haggz is a free service that enables the advertiser in the Digital Assets and any user, who so wishes, to share a listing with his friends on social networks and messaging applications (such as WhatsApp and Facebook) by means of a link leading to a public page of the listing on the Haggz website and to the application. The public page displays the details of the listing, its images, the name of the advertiser and his profile picture, and anyone who has the link can view them even without downloading the application.

In the event that Haggz makes it possible to connect the advertiser's account on a social network (such as Facebook) for the purpose of publishing the listing on it, Haggz will request the advertiser's consent through an "access request" (permission request). Upon receiving the consent, Haggz will use the name of the advertiser and his picture appearing in his profile on that network. The "access request" process is a one-time process. Approval of the request will enable Haggz to use the data in the advertiser's subsequent "share" requests.

The public page of the listing will be available only after the listing has been checked and approved by Haggz, and as long as the listing is published. Haggz is not responsible for the social networks and third-party applications on which the link is shared, nor for any person's use of the link after it has been shared.

16.8 Automatically Calculated Estimates and Indicators (Including an Estimate of the Value of a Property or a Business)

In the event that Haggz displays an estimate of the value of a property or a business, or any other automatically calculated estimate (including an estimate of the expected number of views of a sponsored listing), the information displayed in this context in the Digital Assets is an estimate that relies on the data of Haggz and additional external sources, including (by way of example and without limitation): the Tax Authority, the Central Bureau of Statistics, the Bank of Israel, the Ministry of Education, the local authorities, and others. The data are calculated using an algorithm, including an artificial intelligence algorithm, which weighs (takes into account) a variety of parameters such as location, the area of the property, the floor, and more. Nevertheless, it must be remembered that this is an estimate that relies on general and dry (abstract) data, which cannot reflect all the unique characteristics of each property or business.

The system may also display "information metrics" - that is, visual data and indicators that provide a current and informative picture of the market, by areas such as the city or the neighbourhood. The purpose of the information metrics is to make information about the market accessible to users, at the level of the city or the neighbourhood. Nevertheless, some of the information in the metrics displayed may have changed since it was collected or may no longer be up to date. Haggz makes considerable efforts to update the information and to ensure its accuracy, but it shall bear no liability in relation to its accuracy, and in all cases, the User must independently verify the details contained in them.

In addition, it is important to emphasise the following: any valuation displayed in the Digital Assets is not carried out by a real estate appraiser and does not constitute an appraisal (an official certified valuation). The valuation and the information metrics are displayed in the Digital Assets "as is" (AS IS) and are deemed a recommendation only. They do not replace personal judgement, professional advice, or an individual examination of the property or the business. Haggz recommends that every user carry out an independent examination, including consultation with a qualified real estate appraiser, a lawyer, an accountant, or another appropriate professional.

Therefore, reliance on the valuations and the information metrics in the Digital Assets is at the responsibility of the User alone. Haggz shall bear no liability of any kind - including damage, loss, pecuniary loss or mental anguish - that may result from reliance on the valuations or their use.

16.9 The Haggz Price and Salary Guide

In the event that Haggz displays a price guide or ranges of prices or salaries (such as the salary range in Jobs listings, or the average prices in a particular category), it is calculated on the basis of the data entered by the advertisers and/or on the processing of data that may be carried out by an artificial intelligence algorithm. The database relies on the data of the Digital Assets and may be combined with data of official bodies and external sources. It is clarified that the real price and/or value and/or salary may change, in view of the unique nature of each property, business, service or job and in view of various circumstances and/or updates beyond the control and/or knowledge of Haggz. It is clarified that the valuation obtained is in the nature of a recommendation only, and does not replace any professional information or the personal judgement of the User. It is recommended to carry out an individual (detailed) examination regarding the subject of the listing concerned, including consultation with professionals, appraisers and any relevant body. Haggz shall bear no liability of any kind in relation to actions resulting from reliance on this valuation.

16.10 Notifications and Alerts ("My Alerts")

Haggz sends notifications to your device through the application, including notifications about the approval or rejection of your listing, about the approaching end or the end of the publication period of your listing, about a new application for a job you published or about the status of an application you submitted, about an appointment that was booked, a periodic report on the performance of your listings, and general announcements from Haggz to all users of the application. In addition, Haggz is entitled to make available the "My Alerts" service, which enables you to receive a daily alert about the new listings uploaded to the Digital Assets that match your preferences which you defined in the system, directly to your device and/or to your email address (the notifications and alerts are referred to together in this clause as: the "Mailing Service"). The alert may include listings of Private Customers and of Business Customers. You may register to receive multiple alerts according to different preferences and in accordance with the system settings. Haggz has the exclusive discretion regarding the maximum number of alerts for which it is possible to register, and this quota may change from time to time. You may change the notification settings at any time in the settings of your device and/or in your personal area in the Digital Assets. As long as there are no new listings, you will not receive a new alert. Clicking on the notifications and on the listings appearing in them will direct you to the Digital Assets and/or to your personal area. The display and the priority of the listings may change, and therefore we recommend marking (saving to favourites) the listings that you liked and that you wish to save and see again at a later time.

Haggz reserves the right to discontinue the Mailing Service or to change its terms at any time at its exclusive discretion and without giving prior notice. The display of the Mailing Service, the frequency of the Mailing Service, and the priority of the listings appearing in the mailings may change, at the exclusive discretion of Haggz. In addition, commercial advertisements may be added to the Mailing Service.

In all cases and circumstances, Haggz bears no responsibility for the accuracy, correctness or completeness of the Mailing Service Data, nor for the arrival of any notification or alert or the time of its arrival, nor is it responsible, directly and/or indirectly, for any damage, direct or indirect, caused to any user as a result of the use of the Mailing Service (including any economic, physical, emotional or other damage), and the responsibility rests with the user of the Mailing Service alone. Accordingly, you shall have no allegation, claim or demand against Haggz regarding the Mailing Service. Transactions may not be carried out in absolute reliance solely on the Mailing Service Data, and any such reliance by the browser on such information shall be at the responsibility of the browser alone. In all cases and circumstances, the Mailing Service and the Mailing Service Data should not be regarded as the giving of any recommendation on the part of Haggz.

Any use of the Mailing Service in a manner contrary to the provisions of the Terms of Use and/or the provisions of the law shall entitle Haggz to take one or more of the remedies provided in the Terms of Use, including blocking your use of the Mailing Service, transferring your details to third parties in accordance with any law, and the like, without derogating from any other remedy or right available to Haggz under any law. It is clarified that all the provisions of the Terms of Use relating to copyright and intellectual property shall apply to any content included in the Mailing Service.

By registering for the Mailing Service, you express your wish and give your consent that Haggz and/or anyone acting on its behalf may use the information, in accordance with any law, including sending general information from Haggz, including updates, articles, advertising and marketing information and/or offers to purchase various services or products, by application notifications and/or email and/or text messages and/or WhatsApp and/or automated dialing systems. By using the Mailing Service, you give your consent to the Terms of Use and your consent to receive "advertising material" as defined in Amendment No. 40 to the Communications (Telecommunications and Broadcasting) Law, 5742-1982, as well as your consent under the Protection of Privacy Law, 5741-1981. Haggz will make its best efforts to enable the proper operation of the Mailing Service. At the same time, Haggz does not guarantee the availability of the Mailing Service and shall bear no liability for any direct and/or indirect damage (including any economic, physical, emotional or other damage) caused to the User and/or to a third party as a result of the operation and/or discontinuation of this service and/or as a result of disturbances and/or faults relating to this service (including the unavailability of the Mailing Service and/or the provision of inaccurate data within the Mailing Service). Accordingly, you shall have no allegation, claim or demand against Haggz regarding the Mailing Service. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

16.11 Haggz credits («Haggz points»)

1. Haggz may grant users «Haggz points» for specific actions announced in the app, such as a listing being approved, an appointment completed through the app, a review being published, or inviting a new user whose listing is approved. The invited user may also receive welcome points, credited only after their first listing is approved, not at sign-up.
2. Points are not money or a means of payment and have no cash value. Points can be bought only inside the app, in packs Haggz offers from time to time, through the App Store or Google Play. Points cannot be sold, transferred to another user, or exchanged for money or any consideration outside the app.
3. Points can be used only inside the app, for the benefits Haggz offers from time to time, such as boosting a listing or paying for a publishing period.
4. Earned points become available after a waiting period announced in the app and expire after the announced period. Bought points are available as soon as they are bought and do not expire. When points are used, the points closest to expiring are used first.
5. Haggz may cancel or correct points granted in error or through fraud, abuse or a breach of these terms, and may freeze an account's points while it checks.
6. Haggz may change the points per action, the cost of each benefit and the programme's terms, or end it, with advance notice in the app where possible. Points available before an ending can be used within an announced period.
7. When an account is deleted, all its points end and cannot be restored.
8. A bought points pack can be refunded in full only if the request is made within 7 days of the purchase (or longer where the law requires it), and only if not one point of the pack has been used. There are no partial refunds. Refunds are made through the store where the purchase was made. If the store returns the amount for any reason, the whole pack is deducted from the balance, even if the balance falls below zero, and points cannot be used until the balance is back above zero.

17. Services Provided by a Third Party

The Digital Assets may display advertisements and/or links to websites and/or forms for services that are operated and/or offered and/or provided by third parties, including brokerage services, transport services, the services of mortgage advisers and commercial offers for the financing of loans, services and websites for assistance in searching for work, maps and navigation services (such as Google Maps, Waze and Apple Maps), and others, within the framework of the commercial cooperation that Haggz will conduct with third parties. It is emphasised and clarified, as detailed in the chapter on limitation of liability, that Haggz is not a party to those services and/or offers and/or advertisements and/or information that are provided exclusively by the third parties, and that Haggz is not a party to any engagement.

17.1 Partner Services by Subscription with a Third Party (Such as the Receiver of Assets and Receiver of Vehicles Service)

In the event that Haggz makes access to services of this type available, these services, as well as the sections in which they are located, offer the browsers of the Digital Assets, in return for the payment of a subscription (from daily to annual, with the types of subscriptions varying according to the type of section), the possibility of access to the sale of vehicles and real estate assets that are sold as a result of receivership (including due to attachment, or repayment of debts, or estates). It is hereby clarified that these services are provided and operated exclusively by a third party. Access to the service is through redirection to a separate and external website that is not operated by Haggz. Accordingly, Haggz does not operate the service, is not a party to the offers or the information presented on the external site, and is not a party to any engagement arising therefrom. Haggz shall not be liable for any damage, loss or expense of any type or kind caused to any browser using the said service and/or to anyone acting on his behalf, directly or indirectly, in relation to the service and/or the inaccuracy or incompleteness of the service. Accordingly, you shall have no allegation, claim or demand against Haggz regarding the receiver of assets and/or receiver of vehicles service or any other partner service. The foregoing does not derogate from the other provisions of the Terms of Use, including those relating to the absence or limitation of liability.

17.2 The Haggz Service - New Apartments and Projects from the Contractor

Haggz may also provide information in relation to a variety of new apartments and real estate projects. Within this service, you will be provided with information from contractors, real estate developers and other bodies that establish or build houses, apartments and various residential projects in the country (the "Real Estate Developers"). Among other things, you will be given the opportunity to leave your details and the various Real Estate Developers will be able to contact you regarding the project in which you expressed interest. The services and the products (including the houses, the apartments and their listings) are a third-party service and Haggz is not responsible for them. Their publication does not constitute a guarantee of their correctness or accuracy, and the publication does not constitute a recommendation to purchase any product, service, apartment or house. Haggz reserves the right to use your details in accordance with these Terms and the Privacy Policy and to contact you regarding additional services or products.
